Terms of Use

About these terms

These terms apply to your use of the Utter desktop app (“the app”) and the website heyutter.com. By downloading, installing or using the app, you agree to them. “We” means Victor, the independent developer of Utter.

Your license

When you buy Utter you get a license key. A license is for one person and can be active on up to 3 computers at a time, on macOS and Windows alike. Deactivating it on a computer frees up that seat.

A license includes every 1.x update. Later major versions, such as 2.x, are paid upgrades with a discount for existing customers; if you don’t upgrade, you can keep using the 1.x version you have.

A license lets you use the app; it doesn’t transfer ownership. We keep the copyright and all other rights in the app. You may not resell, rent out or publicly share your license key, crack or get around the license check, or repackage and redistribute the app.

The trial

You can try Utter free for 14 days with every feature. The trial starts the first time the app successfully produces speech. If it ends before you activate a license, each read stops after about the first 100 words; voice previews keep working.

Purchases and refunds

Utter is sold through Creem, the merchant of record, which takes the payment and handles tax and invoices; the Creem Buyer Terms also apply to your purchase. The price is the one shown at checkout.

You can get a full refund within 14 days of buying, no reason needed; see the refund policy. A refunded license stops working.

Voice providers

Utter does not provide speech synthesis itself. You need your own account and API key with xAI, Google (Gemini) or Doubao Speech (Volcano Engine). The provider bills you directly for speech by usage, separately from what you pay us for the license.

Each provider sets its own prices, regions, voices and quality, which can change at any time and are outside our control. If a provider changes or withdraws its API, features that depend on it may stop working; we will do our best to keep up.

Utter is independent software and is not affiliated with or endorsed by xAI, Google, ByteDance or Volcano Engine. Their names and trademarks belong to their owners.

Acceptable use

You must not use Utter to produce, or share what it produced of, any of the following:

  • anything illegal under the laws that apply;
  • pornographic, sexually explicit or sexually suggestive content, and any sexual content involving minors;
  • content that harasses, threatens, expresses hatred, incites violence or encourages self-harm;
  • content that impersonates someone, or is meant to defraud or deceive people;
  • content that infringes copyright, privacy or other rights of others, such as publishing a reading of someone else’s work without permission.

You must also follow the usage policies of the provider you use: the xAI Acceptable Use Policy, the Google Generative AI Prohibited Use Policy and the Volcano Engine Terms of Service (in Chinese).

If you break this section, we may revoke your license.

Privacy

How we handle information is set out in the privacy policy.

Updates

The app checks for updates and downloads them in the background, and you choose when to restart and install them. We do our best to fix problems and keep up with changes to providers’ APIs, but we don’t promise that any feature will be available forever.

No warranty

To the extent the law allows, the app is provided “as is”. We don’t promise that it is free of errors, that it runs on every computer or that what it reads is accurate.

Limitation of liability

To the extent the law allows, we are not liable for indirect losses, lost data or the fees you pay voice providers that result from using or being unable to use Utter, and our total liability is limited to what you actually paid for the license. Nothing in these terms affects consumer rights that the law where you live gives you and that cannot be excluded by agreement.

Ending use

You can stop using and uninstall the app at any time. If you break these terms, we may revoke your license, and the app returns to being unactivated.

Changes to these terms

If these terms change, we will update this page and the date at the top, and mention important changes in the app’s release notes. Continuing to use Utter after a change means you accept the new terms.
